BY ACCEPTING THESE TERMS, YOU AGREE TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION AND WAIVE YOUR RIGHT TO A JURY TRIAL OR CLASS ACTION LAWSUIT.

  • You reside in or require services within the State of Arizona.

  • You agree to be bound by these Terms and our Privacy Policy.

2. NATURE OF SERVICES (CONSTRUCTION DISCLAIMER)

Black Ridge Contracting is a licensed, bonded, and insured General Contractor (ROC #361174).

  • Estimates are Non-Binding: Any pricing, scope of work, or advice provided by our AI Chatbot, website, or over the phone is for informational purposes only and constitutes a non-binding estimate. A binding contract ("Construction Agreement") is only formed after an on-site inspection and the signature of a formal written agreement by both parties.

  • Insurance Claims: While we assist with insurance claims, the final decision on coverage lies with your insurance carrier. We do not guarantee claim approval.

3. MOBILE MESSAGING TERMS (TCPA & TWILIO COMPLIANCE)

By providing your phone number via our website or Chatbot, you expressly consent to the following:

  • Consent: You agree to receive transactional and promotional text messages (SMS/MMS) from Black Ridge Contracting regarding your project, estimates, and appointments.

  • Fees: Message and data rates may apply.

  • Cancellation: Reply STOP to cancel at any time. You will receive a final confirmation message.

  • Help: Reply HELP for assistance or contact support@blackridgeaz.com.

  • Privacy: Your mobile consent data will never be sold or shared with third parties for marketing purposes.

4. INTELLECTUAL PROPERTY

All content on this Site (logos, text, project photos, AI Chatbot responses) is the exclusive property of Black Ridge Contracting. You may not copy, scrape, or distribute our content without written permission.

5. WARRANTIES AND DISCLAIMERS

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • "AS IS" BASIS: THE WEBSITE AND AI CHATBOT ARE PROVIDED ON AN "AS IS" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY OF THE AI CHATBOT'S ADVICE.

  • CONSTRUCTION WARRANTY: WARRANTIES REGARDING ACTUAL CONSTRUCTION WORKMANSHIP ARE GOVERNED EXCLUSIVELY BY THE EXECUTED CONSTRUCTION AGREEMENT AND ARIZONA REGISTRAR OF CONTRACTORS (ROC) REGULATIONS, NOT BY THESE TERMS OF USE.

6. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY ARIZONA LAW, BLACK RIDGE CONTRACTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM:

  1. YOUR USE OR INABILITY TO USE THE WEBSITE OR AI CHATBOT.

  2. RELIANCE ON INFORMATION PROVIDED BY THE AI CHATBOT WITHOUT PROFESSIONAL VERIFICATION.

  3. ERRORS OR OMISSIONS IN ONLINE ESTIMATES.

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Black Ridge Contracting and its officers from any claims, damages, or expenses (including legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party rights.

8. DISPUTE RESOLUTION (BINDING ARBITRATION)

  • Venue: Any legal proceedings excluded from arbitration shall be filed exclusively in the state or federal courts located in Maricopa County, Arizona.

  • Class Action Waiver: You agree to arbitrate solely on an individual basis and strictly waive any right to participate in a class action lawsuit.
